Welcome to Daniel Friesen Photography. Please read these Terms of Service (“Terms”) carefully before using [https://danielfriesen.photography/]

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not access the Site or use any services.

1. Services

We provide professional photography and videography services, including but not limited to event photography, portrait sessions, headshots and commercial photography (the “Services”). Detailed descriptions of our Services can be found on the Site.

2. Use of the Site

  • You must be at least 18 years of age to use our Services.

  • You agree not to use the Site or Services for any unlawful or prohibited purpose.

  • You agree not to use the Site in any manner that could damage, disable, or impair the Site.

3. Booking and Payment

  • All bookings are subject to availability.

  • For specific projects a non-refundable deposit of [percentage] is required to secure your booking. The remaining balance is due [timeframe] before the scheduled session.

  • Payments can be made via E-transfer, Credit Card or a predetermined agreed upon method.

  • All payments will have a 5% GST added onto the invoice

  • No Refunds.
    If there are any concerns with the photos or touchups needed client must let Photographer know within 2 weeks after photo session to make changes. There are no refunds on photos/videos or for sessions or time worked by photographer.

4. Cancellation and Rescheduling

  • Cancellations made [2 weeks] before the scheduled session will forfeit the deposit.

  • Rescheduling requests must be made at least [2 weeks] in advance. We will make every effort to accommodate your request, but we cannot guarantee availability.

5. Delivery of Photos

  • Commercial Work is delivered within 24-48 hours depending on the project. Certain projects will have unique agreed upon delivery time.

  • Headshots are 24-48 Hours

  • Portraits are 1-2 Weeks

  • All digital images are provided in [JPEG, high-resolution] unless otherwise agreed upon.

  • We retain the right to use the images for promotional purposes unless otherwise agreed upon in writing.

6. Intellectual Property

  • All images and content on the Site are owned by Daniel Friesen Photography and are protected by copyright laws.

  • Clients are granted a limited, non-exclusive license to use the images for personal, non-commercial purposes.

  • Commercial use of the images requires a separate agreement. Which will be provided my Daniel Friesen Photography

7. Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our Services or the Site.

  • In no event shall our liability exceed the amount paid by you for the Services.

8. Artistic Release

  • Consistency.

    Photographer will use reasonable efforts to ensure that the Services are produced in a style consistent with Photographer’s current portfolio, and Photographer will use reasonable efforts to consult with Client and incorporate any reasonable suggestions.

  • Style. Client acknowledges and agrees that:

    • Client has reviewed Photographer’s previous work and portfolio and has a reasonable expectation that Photographer will perform the Services in a similar style

    • Photographer will use its artistic judgement when providing the Services, and shall have final say regarding the aesthetic judgement and artistic quality of the Services; and

    • Disagreement with Photographer’s aesthetic judgement or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

9. Downloading and Storage

  • Downloading Images. Photographer will deliver digital images through a custom online gallery or a WeTransfer Link. Client may use the link to send the images to friends, family & other. Client can download the Digital Images through the link sent by photographer

  • Storage. Client will have access to their online gallery or link for 30 days after delivery. It is the clients responsibility to download their photos and store their photos. Photographer is not responsible for storing clients photos after delivery. The client acknowledges that they have 30 days to download their photos from the online gallery. After 30 days the gallery will be deleted and the photographer may no longer have access to clients photos.

10. Changes to the Terms

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
